No Purchase Necessary. The “Ekset Apparel SRT4 Giveaway” Promotion (the “Sweepstakes”) begins at 8 a.m. Pacific Time (“PT”) on June 22, 2006, and ends at midnight on November 30, 2006 (PT).
ELIGIBILITY: Entrant must be 18 years of age or older at time of entry and a legal resident of the 48 contiguous United States and the District of Columbia. Void in Hawaii, Alaska, and where taxed, restricted or prohibited by law. Employees of Ekset Apparel and their parent companies, affiliated companies, advertising and promotion agencies, prize providers, participating dealers, sales representatives, distributors (collectively, the “Sweepstakes Affiliates”) and any other person or entity directly involved with this Sweepstakes, and their immediate family members (spouses, parents, children, siblings, grandparents) and those with whom such employees are domiciled are not eligible.
THERE ARE 4 WAYS TO ENTER: 1) Online. Visit www.ekset.com (“Entry Site”), complete an online order of $50 or more, and you will be “automatically entered” into the Sweepstakes. You will receive one entry for each $50 purchase you make. 2) Retail Purchase. Complete an Official Entry Form which can be obtained at designated Ekset Apparel live events or participating dealers, after purchasing $50 or more of Ekset Apparel and deposit your completed entry in the Sweepstakes display or entry box. 3) Referral. Once you have made a purchase, and you make a referral to another person, who also makes an Ekset purchase either online or at a participating Ekset retailer, you will receive one entry into the Sweepstakes for each $50 purchase. 4). AMOE (Alternate Means of Entry). You may also enter the Sweepstakes, without making a purchase or referral by hand-printing your name, complete address, date of birth, phone number and email address (if you have one) on a 3” x 5” card or piece of paper, and mailing your entry in a #10 business size envelope to the following address: Ekset Apparel SRT4 Giveaway, 1878 East Avenue, Rochester, NY 14610. Each entry must be legibly hand-addressed (printed, please), and each entry must be mailed in a separate envelope and received no later than November 30, 2006, the official end date of the promotion. Sponsor not responsible for lost, late, misdirected, mutilated, illegible, or postage-due mail. Mechanically reproduced entries will be considered void.
PRIZES AND APPROXIMATE RETAIL VALUES: All prizes will be awarded. There is One (1) Grand Prize of a customized 2004 Dodge SRT-4, including all current aftermarket modifications and remaining original stock components available. Sponsors provide NO verbal or written warranties of any kind. Car is NOT being offered as street legal, and may not comply with state or local emissions requirements. The vehicle is a used vehicle and will be awarded in “as is” condition. Sponsors do not make nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the vehicle, including but not limited to its quality, fitness for purpose or mechanical condition. Sponsors make no representations or warranties in regard to the car’s condition, whether it is “street legal” in a given locale, nor its compliance with state or local emissions laws. Sponsors will not provide any additional verbal or written warranties, and any implied warranties are specifically disclaimed. Car prize does NOT include as part of the prize: options, taxes, fees, title costs, registration and insurance. Prize consists only of those items specifically listed as part of the prize. Certain conditions and restrictions apply. Sponsors will deliver the vehicle to the confirmed Grand Prize Winner’s place of residence within the 48 contiguous United States (includes DC) (method and timing of the delivery to be determined solely by Sponsor). Winner must take delivery of vehicle within thirty (30) days of notification; failure to do so may result in prize forfeiture and selection of an alternate winner. If winner is below the legal age of majority in state of residence, parent or legal guardian will be required to take possession. Sponsors make no representation or warranty that vehicle can be sold, bartered, or traded for or at the stated Approximate Retail Value (“ARV”) of $10,000. Value is subject to market conditions which can fluctuate. If for unanticipated reasons the car is not available to be awarded, an alternate prize of equal value will be offered, at the Sponsor’s sole discretion.
There are two (2) First Prizes of an Xbox360 gaming console, having an ARV of $399.99
There are five (5) Second Prizes of a Duff’s Shoes International gift certificate good for one (1) pair of shoes, having an ARV of $39.95 each.
Total ARV of prizes to be awarded: $11,000.
DRAWING/WINNING: Potential prizewinners will be selected in a random drawing on or about December 20, 2006 by an independent agent of the Sponsor, whose decisions on all matters related to the Sweepstakes are final. Odds of winning will depend on the total number of eligible entries received. Grand Prize winner will be notified by phone initially and confirmed in writing. First and Second Prize winners will be notified by phone, email or some form of home delivery within 4 weeks of the drawing date via the phone number, email or address listed on the entry. If any winner notification or prize is returned as undeliverable, the prize will be forfeited in its entirety and an alternate winner will be selected. Prizes are not transferable, and no prize substitutions are allowed or cash alternative offered, except at the sole discretion of the Sponsor. Prizewinners are responsible for all federal, state and local taxes, if applicable.
Grand Prize winner will be required to complete, sign and return a notarized Affidavit of Eligibility, a Liability Release, and except where prohibited, a Publicity Release within ten (10) calendar days after notice is sent or the prize will be forfeited and an alternate winner will be selected. Except where prohibited, acceptance of a prize by winner constitutes consent that winner’s name, likeness, voice and/or biographical data may be used for advertising and promotional purposes in relation to this promotion and prize without limitation and without additional notice, compensation or consent.
TERMS/CONDITIONS: By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. Sweepstakes is subject to all federal, state and local laws and regulations.
The Sweepstakes Affiliates are not responsible for any incorrect or inaccurate entry information, printing or typographical errors, human errors, technical malfunctions, failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any website. Proof of entering information at the Ekset Apparel website, depositing an entry or mailing an entry is not considered proof of delivery or receipt. Sponsors reserve the right at their sole discretion to disqualify any individual that Sponsors deem have entered in an unfair manner. Sponsor further reserves the right to cancel, terminate, modify or suspend the online portion of the Sweepstakes, should they encounter technical problems beyond their reasonable control, with appropriate alternate method of prize award selected from among all entries received up to the point of termination.
Any entry information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules, and with the Ekset Apparel Online Privacy Policy, which can be found at www.ekset.com. Sweepstakes entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified. All entries must include a valid e-mail address for the entrant. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address. This contest is intended for viewing in the 48 contiguous United States and DC only and shall be construed and evaluated only according to United States law. Do not enter this contest if you are not located in the eligible 48 United States or DC.
By participating in the promotion, entrant agrees to hold harmless the Sweepstakes Affiliates from any injury, loss or damage to person, including death or property, due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any Sweepstakes-related activity or participation or inability to participate in the Sweepstakes.
WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
GOVERNING LAW: This Sweepstakes and the rights and obligations of the Sponsors and participants will be governed by and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of California, County of Los Angeles. The parties consent to the jurisdiction of the state courts of California and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Sweepstakes.
